General Conditions and Terms of Use

INTRODUCTION

The desktop and mobile website and the smartphone and tablet applications of LuxuryEstate.com (hereinafter "Site and App") are owned by Luxury Estate s.r.l. (VAT no.: 10723800966), with registered office at Via Santa Tecla 4, 20122, Milan (hereinafter "Luxury Estate" or "Owner").
L'utilizzo di qualsiasi servizio (di seguito "Servizi") fornito da LuxuryEstate o semplicemente l’accesso a Sito e App attribuisce all’utilizzatore lo status di Utente ("Utente") e comporta il rispetto e l’accettazione di tutte le presenti Condizioni Generali di Utilizzo (di seguito "Condizioni" o "Termini d’Uso"). Qualora l’Utente non intenda accettare le presenti Condizioni, è tenuto ad astenersi dall’utilizzo di Sito e App.
These Conditions govern the use of the Services offered by Luxury Estate and do not apply to any additional services that may be provided by third parties.
These Terms of Use, together with the Privacy Policy available at the link "Privacy Policy", constitute the entire agreement between the Owner and the User in relation to the use of LuxuryEstate and supersede any prior agreement or understanding.

USER TYPES

The use of the Services on the Site and App is restricted exclusively to adults.

With regard to the use of the Site and App, two types of users are distinguished: Standard Users and Professional Users.
Standard Users are private individuals who use the Site and App with the aim of searching for properties and information. Standard Users may access some services (e.g. property search) anonymously, while for other services (e.g. saving listings, contacting an agency, etc.) registration is required before use.
Professional Users are real estate agents, other professionals and companies operating in the real estate sector who use the Site and App to publish listings and provide services to Standard Users. Professional Users may only access the services intended for them after entering into a service agreement (hereinafter "Service Agreement") with Luxury Estate and obtaining authorisation.

In order to verify the qualification of Professional Users, the Owner may carry out specific checks both before and after the publication of listings. Should the User fail to cooperate or respond to the aforementioned requests, Luxury Estate reserves the right not to publish and/or to delete the listing attributable to them.

CONDUCT RULES AND PROHIBITED USES

LuxuryEstate is not a real estate agency. Information relating to properties available on LuxuryEstate is entered by third parties, real estate agencies, construction companies and other industry professionals (hereinafter also "Advertiser Users"). The details, information, photos, videos and characteristics ("Details") of properties are hosted on LuxuryEstate in good faith; the Owner does not verify the Details provided by Advertiser Users and therefore does not guarantee their accuracy or completeness.
It is prohibited to engage, directly or indirectly, in any form of commercial exploitation of the Services through the access, use, or transfer of information contained in the Site and App. Violation of this prohibition will be prosecuted in accordance with the law. The User acknowledges and accepts that the use of the content and/or Services offered by the Site and App is entirely at their own risk and responsibility.

The User undertakes to use the Site and App and all its content and Services in accordance with the law, public morality, public order and the provisions of these Terms of Use. Likewise, the User undertakes to make appropriate use of the Services and/or content of the Site and App and not to use them for unlawful, bad-faith or criminal activities, to violate the rights of third parties and/or regulations that infringe intellectual property rights, or any other provision of the legal system.

In particular, the User undertakes not to transmit, introduce, distribute or make available to third parties any material or information (data, messages, images, audio files and images, photographs, software, etc.) that is contrary to the law, morality, public order and these Conditions. The use of the Site and App for purposes other than those intended by the Owner is prohibited.
Furthermore, the Owner reserves the right to deny access to services and content of the Site and App at its sole discretion in accordance with its commercial policy. Likewise, the Owner reserves the right to revoke access to its pages without notice to any User who violates the provisions of these legal terms.

Advertiser Users may also purchase services that offer additional visibility to their listing. In any case, the purchase of any service does not guarantee the listing’s continued presence on the Portal, as the listing must fully comply with these Conditions.

INTELLECTUAL PROPERTY

The Services and everything present on the Site and App, including but not limited to, activities relating to the design, development, copying, search results, information or elements contained in the texts, the documents, images, graphics, structure, layout and underlying software code are protected by copyright and trademarks and are subject to the intellectual or industrial property rights of the Owner.
Unless expressly authorised by the Owner or by third parties holding the corresponding rights, or unless legally authorised, the User may not reproduce, transform, modify, decompile, distribute, rent, make available to anyone or allow access through any form of public communication to any of the elements mentioned above.

WARRANTIES AND LIABILITY

LuxuryEstate and its related Services are provided "as is" and "as available". The Owner therefore does not guarantee the continuity of access, nor the correct display, download or use of the elements and information contained in the pages of the Site and App, which may be prevented, hindered or interrupted by factors or circumstances beyond its control. The Owner is not responsible for information and other content embedded in third-party areas or sites accessible from the Site and App. The Owner assumes no responsibility with regard to information, content, products and services offered or provided through the Site and App by third parties or entities.
The User expressly accepts that the use of the Site and App and the Services is entirely at their own risk. Neither the Owner nor third-party information providers assume any liability for damages, losses, claims or expenses arising from: (i) interference, interruptions, errors, omissions, telephone failures, delays, blockages or disconnections in the operation of the electronic system caused by deficiencies, errors and overloads on telecommunications lines and networks, or for any other cause beyond the Owner’s control, (ii) the use of any illegal and/or malicious software of any type of media, such as viruses or the like, (iii) improper or incorrect use of the Owner’s sites, (iv) browsing security or errors caused by malfunctioning browsers or outdated browser versions, or by obsolete hardware.

THIRD PARTIES

The Site and App contain data and information provided by third parties (e.g. property descriptions), therefore LuxuryEstate assumes no responsibility for any inaccuracies or incorrect information. The User acknowledges and accepts that any contractual or non-contractual relationship formalised with Advertiser Users or third parties contacted through the Site and App, as well as participation in competitions, promotions, sale of goods or services, will be carried out solely and exclusively between the User and the Advertiser Users and/or the third party. Consequently, the User accepts that the Owner bears no liability for any damages of any nature in connection with negotiations, conversations and/or contractual obligations with Advertiser Users or third-party natural or legal persons contacted through the Site and App.

BROWSING LISTINGS

The search for information on the Site and App and the viewing of listings is carried out through automated procedures. The Owner therefore declines any liability with regard to the quality of the results offered, the content, accuracy, truthfulness and compliance with the rules set out in these Conditions.
The User may report any illegal, fraudulent, suspicious listings or listings that do not comply with the rules set out in these Conditions by sending a report to the editorial team of the Site and App via email at the following address info@luxuryestate.com. The same contact may be used to submit a complaint against a decision made by the Owner following a received report. Against decisions made by the Owner regarding reports and any complaints, the User may appeal to any out-of-court dispute resolution body certified by the digital services coordinator appointed pursuant to European digital services regulations, or to the judicial authority.

Listings on the Site and App are published by Advertiser Users. Their publication does not imply approval or endorsement by LuxuryEstate, nor does it imply any form of warranty on the part of the latter regarding their content. The Owner is therefore not responsible for the truthfulness, accuracy, completeness, nor for compliance with privacy regulations and/or any other aspect of such listings. When searching for a property on the Site and App, the main parameters that affect the order in which listings appear are: the selected search criteria; any purchase by advertisers of services offering additional visibility to the listing; interactions relating to the individual listing; the completeness and accuracy of information and content relating to the listing. The results that appear once the search is performed may also be sorted by selecting, for example, the most relevant listings, the most or least recent listings, listings with the most or least expensive properties, larger or smaller properties, or properties with more or fewer rooms.

PUBLICATION OF LISTINGS

The publication of listings by Professional Users is governed, in addition to these General Conditions, also by the Service Agreement.

The publication of listings is subject to the following rules:
  • publish listings in accordance with the law, public morality, public order and these Conditions;
  • publish listings for lawful purposes, whose content and/or information does not violate or infringe third-party rights on any grounds (e.g. privacy, intellectual property, etc.);
  • publish listings for properties of which you are the owner or for which you have been duly authorised by the owner to publish;
  • publish listings containing correct and up-to-date data that you have the right to disclose, excluding any improper reference to cadastral data and/or further information in conflict with personal data protection regulations;
  • publish listings whose sole purpose is the sale or rental of the advertised property;
  • publish only images or videos that you have full rights to and that are relevant to the listing;
  • publish photos or images within the dedicated section, excluding those depicting objects or subjects not related to the listing, screenshots including device interfaces, faces of persons, readable vehicle licence plates, logos of other portals, large logos, highly prominent logos or logos that obstruct the view of the photo or image;
  • enter the required information exclusively in the designated fields;
  • publish in the "virtual tour" video only multimedia content relevant to the property;
  • publish only properties that are available and not properties that have already been sold or rented;
  • include in the listing only accurate and non-misleading information.
The publication of listings offering subscription-based property search services and/or listings requiring payment to access information on properties published by Advertiser Users is not permitted.

By publishing listings, Advertiser Users grant LuxuryEstate a licence of a non-exclusive nature, valid for the entire duration of the relationship and for the period strictly necessary for its performance, to reproduce, distribute, perform, display and adapt their content. With reference to permanent editorial content (by way of example, blog articles, social posts, promotional material produced with content provided by the client), the aforementioned licence remains valid even after the end of the relationship, being limited exclusively to the use already made of the content at the time of termination, without the possibility of new uses of the material.
LuxuryEstate is not required to pay any amount for such material.

The Advertiser User expressly acknowledges and accepts that the Owner may verify compliance with the aforementioned rules and the Conditions in general, including through automated checks nonetheless connected to and dependent on human activity, and if a violation or suspected violation is found, the Owner shall be free to remove non-compliant content, suspend or terminate the Services, remove listings or reduce their visibility and positioning. The Owner therefore reserves the right to delete listings permanently or temporarily, at its sole and absolute discretion.

PRIVACY

Users’ personal data is processed in accordance with applicable regulations. For further information, please refer to the Privacy and Personal Data Protection Policy available at the link "Privacy policy".

SECURITY

The Owner has adopted the security measures deemed appropriate to ensure the confidentiality and privacy of personal data, as defined under applicable legislation. For further information, please refer to the Privacy and Personal Data Protection Policy available at the link "Privacy policy".

COOKIES

Some pages of the Site and App use cookies that are non-invasive, not harmful and do not contain personal data: the sole function of cookies is to personalise the browsing experience. The User may activate their browser settings to refuse the installation of cookies. For further information, please refer to the Cookie Policy at the link "Cookie policy".

TERMINATION

The Owner reserves the right to prohibit access to the Site and App, permanently or temporarily, at its sole and absolute discretion. Users subject to the exclusion measure will be informed of such a decision and may not subsequently attempt to access the site under a different name or through other Users.

The User shall be liable for any damages of any kind that the Owner or its subsidiaries may suffer, directly or indirectly, as a result of any breach of the obligations arising from these Conditions in relation to the use of the Site and App. Furthermore, the User shall hold the Owner harmless from any penalties, claims or legal proceedings brought by third parties, including public authorities, against the Owner, its employees or collaborators, as a result of the User’s violation of third-party rights while using the Site and App or related services in a manner contrary to these Conditions.

AMENDMENTS

The Owner reserves the right to make any changes deemed appropriate, including modifying, deleting and adding new content and/or services as well as the manner in which they are presented and localised.

Any amendments will be published on the Site and App and will become effective upon publication. Continued use of the Services after the effective date of such amendments will constitute acceptance of those amendments.

DURATION AND TERM

Free Services and/or content of the Site and App may be provided for an indefinite period as long as the user’s account remains active; furthermore, where specified, paid services are bound to the time period indicated on the listing publication process page within the Site and App.
The Owner has the power to unilaterally close, suspend or terminate the provision of the Service and the Site and App at any time and without notice.

GOVERNING LAW AND JURISDICTION

Unless otherwise provided by mandatory legal provisions and by consumer protection regulations, the Court of Milan shall have exclusive jurisdiction to settle any dispute concerning these Conditions and the relationships governed thereby.

Privacy Policy

INTRODUCTION

This information notice is provided, pursuant to Articles 13 and 14 of EU Regulation 679/2016 (hereinafter, the "Regulation" or "GDPR"), to the users (hereinafter: "Users" or "User") of the website in its desktop and mobile version https://www.luxuryestate.com/it/ and of the LuxuryEstate application (hereinafter: "Website and App") owned by the company Luxury Estate S.r.l., Data Controller of personal data (hereinafter: "Data Controller"), and is intended to describe the management methods of the Website and App with reference to the processing of personal data, as well as to allow Users of the Website and App to know the purposes and methods of processing of personal data by the Data Controller in case of provision of the same.

As specified in the General Conditions and Terms of Use, the services offered by the Data Controller are intended for persons over 18 years of age. Should the Data Controller become aware of the processing of data of minors under 18 years of age, without a valid consent of the parents or of a legal guardian, it reserves the right to unilaterally interrupt the enjoyment of the service offered, as well as to delete the acquired data.

Terms not defined in this Personal Data Protection Information Notice have the same meaning as described in the General Conditions and Terms of Use.

Users who publish real estate advertisements undertake to comply with the General Conditions and Terms of Use, also with regard to the protection of personal data. Users assume responsibility for any communication and publication of third-party data, warranting that they have the full right to communicate them. The Data Controller is released from any liability towards third parties arising from the unlawful use of their data.

This information notice is provided exclusively for the Website and App of the Data Controller and does not concern other websites accessible by the User through any links present on the Website and App.

PRINCIPLES APPLICABLE TO DATA PROCESSING

The Data Controller, pursuant to and for the purposes of the Regulation, hereby informs that the aforementioned legislation provides for the protection of natural persons with regard to the processing of personal data and that such processing shall be inspired by the principles of fairness, lawfulness, transparency and protection of confidentiality and fundamental rights.

TYPES OF USERS

As described in the General Conditions and Terms of Use, in relation to the use of the Website and App, the following types of Users are distinguished:
  • Simple Users (e.g. private individuals): they may access certain services (e.g. the search for real estate) anonymously, while for other services (e.g. saving an advertisement, automatically receiving updates, etc.) they must register before use;
  • Professional Users (e.g. real estate agents, professionals operating in the real estate sector, etc.): subject to the conclusion of a Service Agreement, they have access to certain services intended for them.

PURPOSES AND LEGAL BASIS OF PROCESSING

Personal data provided by Users through the use of the Website and App are processed by the Data Controller for the purposes described below:
  1. Provision of the service for Simple Users:
    1. In order to provide certain services (e.g. saving a search, automatically receiving information about new advertisements, etc.) it is necessary for the User to register through the Website and App. The data necessary for registration are limited to the provision of:
      • First name;
      • Last name;
      • Email address;
      • Telephone number.
    2. The User, by accessing his personal section present on the Website and App (hereinafter "User Profile"), may optionally provide other personal data as additional information (e.g. date of birth, gender, residence) which will be collected by the Data Controller if provided.
    3. The User may explicitly and voluntarily request information by e-mail to the addresses indicated on the Website or by filling in the "Contact us" form. In such case, the Data Controller acquires the User's e-mail address, first and last name, and any personal data entered in the communication or in the "message" section.
  2. Provision of the Contact Advertisers, Sell with us, Evaluate your home and Save advertisement services:
    1. In order for Advertisers to provide the User with the information he requests in relation to the real estate, the "Contact Advertisers" service allows the User to forward his personal data to real estate agencies, other companies and real estate professionals who publish real estate advertisements. In particular, by filling in the contact form present in the advertisements, the User provides the following personal data: first name, e-mail address, telephone. The User may also choose to provide other personal data or insert further information in the "message" box.
    2. In order to obtain information and support in the sale of real estate, the "Sell with us - private seller" service allows private individuals to obtain information and support for the sale of real estate from a limited number of real estate agencies. In particular, in the case of a private seller (owner), the User provides the following personal data: address and characteristics of the property; information on the availability of the property; first name; e-mail; telephone.
    3. In order to know the value of a property, the User may make use of the "Evaluate your home" service to obtain a valuation from a limited number of real estate agencies. In such circumstance, the User may provide the following personal data: address and characteristics of the property; information on the availability of the property; first name, e-mail; telephone.
    4. The User, after saving an advertisement, may choose to receive further information on the saved advertisements from the Advertisers. In such case, the User may provide the following personal data: address and characteristics of the property, information on the availability of the property, first name, e-mail, telephone.
  3. Information, promotional and profiling activities:
    In order to allow the User to obtain sector information such as news and curiosities, as well as advertising information, the User may, by means of express consent, subscribe to the Information, promotional and profiling activities service in order to receive informational, promotional and marketing communications, based, in some cases, on the activity carried out on the Website and App.
    The User may cancel at any time the subscription to such communications, by deselecting the following options, present on the User Profile page:
    • "I wish to receive informational and promotional communications";
    • "I wish to receive the LuxuryEstate newsletter".
    The Data Controller may thus carry out activities of analysis of the interests, habits and choices of the Users, also in order to be able to send them personalised promotional material on the services offered.
  4. Provision of the service for Professional Users (Sell with us - Professional seller):
    In order to allow professional operators to qualify as Professional Users, subject to the conclusion of a Services Agreement with the Data Controller, it is necessary for the operator to provide the personal data indicated below, in order to be contacted with a view to learning about the services dedicated to professionals:
    • First name
    • Last name
    • Email address
    • Telephone number.
The processing of personal data for the purposes referred to in letters A (a), B (a)(b)(c)(d) and D, finds its legal basis in Art. 6 par. 1, letter b), of the GDPR, namely in the performance of a contract to which the data subject is party or in the implementation of pre-contractual measures taken at the data subject's request.

In the other cases referred to in letter A (b)(c), as well as for the purposes referred to in letter C), data processing finds its legal basis in Art. 6, par. 1, letter a), of the GDPR, namely in the consent expressed by the data subject.

METHODS OF PROCESSING AND STORAGE OF DATA

The Data Controller ensures that personal data are processed in full compliance with the GDPR and the privacy legislation in force, by means of manual, IT or telematic systems. Processing may also be carried out by means of automated tools suitable to store, manage and transmit the data themselves.

The data collected and processed shall be protected by physical and logical methodologies in order to minimise the risks of unauthorised access, disclosure, loss and destruction of the data, pursuant to Articles 25 and 32 of the Regulation.

Data processing shall last no longer than necessary to satisfy the purposes for which they were collected, such as the storage of search criteria, notification, publication of advertisements and the contacting of professional operators.

Pursuant to Art. 7 par. 3 of the Regulation, the data subject has the right to obtain at any time the withdrawal of consent to processing.
To request the deletion of his personal data, the data subject may send a request to the e-mail address privacy@luxuryestate.com.

In the absence of a deletion request received by the Data Controller, the personal data relating to accounts shall be retained for a period not exceeding 5 (five) years, starting from the date of the User's last access to the Website and/or App. Browsing data shall be retained for a period not exceeding 24 (twenty-four) months, starting from the date of collection and according to the consents expressed during browsing. Marketing data shall be retained until the possible withdrawal of consent by the User.

Upon expiry of such retention periods, the User's data are permanently deleted or anonymised.

RECIPIENTS OF DATA

The personal data collected may be processed by persons or categories of persons acting as Data Processors of data processing pursuant to Art. 28 of the Regulation or who are authorised to process data pursuant to Art. 29 of the Regulation.

Furthermore, for some services, data may be communicated to companies that collaborate with or use the services of the Data Controller (for example the individuals who propose information about the properties), with the sole aim of providing the services requested by the User. In these cases, the companies are autonomous controllers, therefore the Data Controller is not responsible for the processing of data by them. The Data Controller is also not responsible for the contents and the compliance with the legislation on the protection of personal data by websites not managed by the Data Controller.

Outside the cases indicated above, personal data shall not be subject to communication, save to persons, entities and Authorities to whom communication is mandatory by virtue of legal or regulatory provisions.

TRANSFER OF PERSONAL DATA

Personal data collected through the Website and App may be transferred outside the national territory solely and exclusively for the performance of the services requested through the Website and App, in order to provide the most appropriate responses to the requests made, to improve the services requested and in compliance with the specific provisions set forth by the Regulation.

Some personal data may be shared with recipients located outside the European Economic Area. In such cases, the Data Controller ensures that any transfer of data shall take place in full compliance with the GDPR, namely to Countries that have obtained an adequacy decision and, where necessary, by means of the so-called Standard Contractual Clauses.

COLLECTION OF BROWSING DATA

The IT systems and the technical and software procedures underlying the operation of the Website and App acquire, in the course of their normal operation, certain personal data whose transmission is implicit in the access and operating mechanisms and protocols in use on the Internet.

Each time the User connects to the Website and App and each time he calls up or requests a content, the access data are stored in our systems, in the form of tabular or linear data files. This category of data includes, for example, IP addresses, the domain names of the computers used by the users connecting to the Website and App, the request from the User's browser, in the form of addresses in URI (Uniform Resource Identifier) notation, the date and time of the request to the server, the method used in submitting the request to the server, the amount of data transmitted, the numerical code indicating the status of the response given by the server and other parameters relating to the User's operating system and IT environment.

These data may be used by the Data Controller for the sole purpose of obtaining anonymous statistical information on the use of the Website and App in order to identify the pages preferred by Users and thus provide ever more adequate contents and to monitor their proper operation. Upon request of the Authority, the data may be used for the ascertainment of liability in the event of hypothetical computer crimes to the detriment of the Website and App or its Users.

Such data are collected even if the User has not logged in to the account created through the Website or App or has not registered. Such data shall be retained by the Data Controller for a period not exceeding 24 (twenty-four) months, starting from the date of collection.

INFORMATION ON COOKIES

Cookies have the purpose of speeding up the analysis of Internet traffic, facilitating Users' access to the services offered by the Website and App and providing useful and relevant advertising to visitors. Should he not wish the information he provides to be collected through the use of cookies, the User may apply a simple procedure present in his browser that allows the cookies function to be refused.

When using the Website and App with the position detection function activated, the Website and App may collect and process information about the User's current position. These data are processed in anonymous form, in a format that does not allow the User to be personally identified, and used for the sole purpose of facilitating the use of certain location-based functions of the Website and App. The location services may be activated or deactivated by the User at any time by accessing the settings of his device.

RIGHTS OF THE DATA SUBJECT

The User, in accordance with the methods specified in the following paragraph, has the right to request at any time:
  1. confirmation of the existence or otherwise of personal data concerning him, even if not yet recorded, in a concise, transparent, intelligible and easily accessible form, in simple and clear language;
  2. the indication:
    1. of the origin of personal data;
    2. of the purposes and methods of processing;
    3. of the legitimate interests pursued by the Data Controller or by third parties;
    4. of any recipients or any categories of recipients of personal data;
    5. of any intention of the controller to transfer personal data to a third country or to an international organisation;
    6. of the retention period of personal data;
    7. of the logic applied, as well as the importance and envisaged consequences of such processing for the data subject, in case of processing carried out with the aid of electronic tools within an automatic process of collection and/or profiling;
    8. of the identification details of the Data Controller, the Data Processors, of any appointed Representative and of the Data Protection Officer (so-called DPO);
    9. of the persons and categories of persons to whom personal data may be communicated or who may become aware of them in their capacity as appointed representative in the territory of the State, as data processors or appointed persons;
  3. the possibility of lodging a complaint with a supervisory Authority;
  4. the updating, rectification or, where there is an interest, the integration of the data;
  5. the erasure, transformation into anonymous form or the blocking of data processed in violation of the law, including those whose retention is not necessary in relation to the purposes for which the data have been collected or subsequently processed;
  6. the restriction of processing;
  7. the portability of personal data concerning him to another Data Controller;
  8. the withdrawal of processing;
  9. the attestation that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disclosed, except in the case in which such fulfilment proves impossible or involves the use of means manifestly disproportionate in relation to the protected right;
  10. the objection, in whole or in part, on legitimate grounds, to the processing of personal data concerning him, even though pertinent to the purpose of the collection.

DATA CONTROLLER AND DATA PROTECTION OFFICER

In order to exercise the rights referred to in the previous point, the data subject may at any time address the Data Controller and/or the Data Protection Officer, as well as for any communications regarding the processing of his Personal Data, or to know the updated list of any Data Processors appointed by the Company. To this end, the data subject may contact by means of appropriate written communication without formalities:
